Dhannalal alias Dhanraj (D) through LRS vs Nasir Khan and Ors

Bench: 2 — K. Vinod Chandran, N. V. Anjaria

In Brief

An injured man filed an appeal seeking enhanced motor accident compensation after being rendered 100% disabled. He died during the appeal proceedings in April 2024, unrelated to his injuries. His legal representatives substituted themselves to continue the appeal. The Supreme Court held that the right to claim compensation survives to legal representatives even if the injured dies during proceedings, provided the death is unrelated to injuries. The Court awarded Rs 20,37,095 in total compensation, accepting Rs 9,000 as the injured's monthly income, applying an 11-year multiplier (actual lifespan rather than standard 14), and including 25% for future prospects. Interest was set at 9% from the claim filing date.
