Kavin vs P. Sreemani Devi & Ors

Bench: 2 — N. V. Anjaria, Atul S. Chandurkar

In Brief

A bus passenger aged 21 suffered 100% permanent disability in a 2011 accident while pursuing his arts degree. The Claims Tribunal awarded Rs. 67.83 lakh in compensation, but the High Court reduced it by Rs. 19 lakh. The Supreme Court held that compensation for loss of future income is a distinct head separate from permanent disability compensation. Given the victim's young age and vegetative state, the Court enhanced compensation for future medical expenses to Rs. 15 lakh, attendant charges to Rs. 10 lakh, and restored compensation for permanent disability, loss of enjoyment of life, and family pain and suffering. The claimant was entitled to Rs. 82.83 lakh in total compensation, payable within four weeks at 7.5% interest per annum.
