In Brief
A peon employed on a daily-wage basis was terminated in 1987 after working for about five years. The Labour Court found the termination violated the Industrial Disputes Act and ordered reinstatement with back wages. The High Court reversed this, holding the initial appointment was irregular and reinstatement was inappropriate after 30+ years of unemployment. The Supreme Court upheld that reinstatement was not justified given the long period out of service, but enhanced the compensation awarded from Rs. 50,000 to Rs. 1,50,000, with the balance to be paid within eight weeks.
