This appeal challenged a High Court order upholding the transfer and termination of an employee at Wockhardt Ltd. The Supreme Court held that employers have the discretionary right to transfer employees in the interest of the establishment under the contract of employment. While a transfer could constitute an unfair labour practice if actuated by personal malice (malice in fact), the appellant failed to substantiate such claims. The Court found the Labour Court (not the High Court) to be the proper forum for deciding unfair labour practice disputes. Finding no merit in the appeal, it was dismissed.
