Dharmendra and others were convicted of murdering Arvind under Section 302 read with Section 34 IPC. The appellants challenged this on grounds that the FIR was manipulated, the accused Balli was under externment so could not be present, and Dharmendra's participation was unproven. The Supreme Court upheld the conviction, finding the eyewitness accounts (uncle and brother of the deceased) reliable and unblemished, that Dharmendra's recovery of weapons on his disclosure statement and flight with the other accused established his guilty participation, and that an externment order does not preclude actual presence. The appeal was dismissed.
