Dharmesh @ Dharmendra @ Dhamo Jagdishbhai @ Jagabhai Bhagubhai Ratadia & Anr vs State of Gujarat

Bench: 2 — Sanjay Kishan Kaul

In Brief

Two persons were killed in an alleged altercation in 2019, and 13 accused were arrested, including the two appellants. The High Court granted bail to the appellants but imposed a condition requiring them to deposit Rs. 2 lakh each as compensation to the victims' heirs within three months. The Supreme Court held that compensation to victims can only be awarded after conviction and sentencing, not as a condition of bail. The Court set aside the compensation condition and replaced it with geographical restrictions and police station attendance, consistent with conditions imposed on co-accused who had already been released on bail.
