Dheeraj Mor and others challenged the eligibility rules of Delhi High Court and other courts that prevented subordinate judicial service members from competing for District Judge positions reserved for direct recruitment from the Bar. The Supreme Court upheld the existing dual recruitment structure. The Court held that the Constitution provides two separate pathways—promotion from judicial service and direct recruitment from the Bar—and High Court rules maintaining distinct quotas for each category are constitutional. The Governor's appointment power must be exercised in consultation with the High Court and encompasses direct recruitment, promotion, and absorption. Law Commission observations on a hypothetical All India Judicial Service have no bearing. The appeals were dismissed.
