A guest lecturer in Karm Kand (Vedic ritual science) at Mahatma Gandhi Kashi Vidyapeeth sought regularization after the Chancellor rejected his appointment, claiming Karm Kand was fundamentally different from Sanskrit and he lacked proper qualifications. The Court held that the University's Statutes contained no specific qualifications for the Karm Kand post and the Academic Council had expressly approved that Karm Kand and Sanskrit qualifications be treated as equivalent. The Chancellor had improperly expanded his enquiry beyond the scope of the High Court's remand order. Having taught the subject for 16 years and being recommended by the Sanskrit Department's Selection Committee, the appellant was entitled to regularization."
