Pooran Chand was appointed as Assistant Professor at King George Medical University in 2005 under a statutory advertisement and selection process. Respondent No.4, initially appointed as Lecturer, was promoted to Assistant Professor in 2007. He later challenged Pooran Chand's appointment and claimed seniority before the Chancellor in 2009—over three years after the original appointment. The Chancellor rejected his representation. The High Court quashed the Chancellor's order and directed Pooran Chand be treated as appointed to the lower post of Lecturer. The Supreme Court allowed the appeal, holding that respondent No.4 could not challenge an appointment four years later without using the three-month statutory remedy provided under the Act, and that the High Court erred in entertaining the challenge when respondent had never questioned the appointment itself before the Chancellor, only claimed seniority."
