In Brief
The Director General of Police appealed against a High Court order reinstating a government employee with continuity of service after her resignation was accepted. The key issue was whether an employee could withdraw a resignation after the employer had accepted it. The Supreme Court held that once a resignation is accepted by the authority, the employee cannot withdraw it and the cessation of service takes effect immediately. The Court also found that the authority could validly accept the resignation from an earlier date, effectively waiving the notice period. The appeal was allowed and the reinstatement was set aside.
