A sweeper employed on a contractual basis at Rs.500 per month was terminated without statutory notice or retrenchment compensation in breach of the Industrial Disputes Act. While the Labour Court and High Court ordered reinstatement with back wages, the Supreme Court held that such remedy was inappropriate given the purely contractual nature of the appointment and four-year tenure. The Court modified the order, awarding Rs.3 lakh lump sum compensation instead, finding this better suited to the contractual relationship and meeting the ends of justice."
