The Supreme Court restored compensation of Rs. 15,51,030 awarded by a Motor Accident Claims Tribunal to a 54-year-old claimant who suffered permanent physical disability (50%) and resulting functional disability (100%) after being struck by a negligently driven car while travelling on a scooter. The High Court had arbitrarily reduced the award to Rs. 7,88,150 by rejecting the Tribunal's assessment of functional disability without proper justification. The Court held that the Tribunal's meticulous, evidence-based evaluation of injuries, loss of earning capacity, medical expenses, and damages deserved deference. The appellant's appeal was dismissed and the claimant's appeal was allowed.
