Dr. Jacob K. Daniel challenged the University's refusal to grant him pensionary benefits as a permanent employee after he retired from his position of Lecturer in Mathematics at Mahatma Gandhi University. He had been appointed in 1996 and his salary was later protected at a higher amount. The Supreme Court held that since the appointment letter contained no clause indicating temporary employment, and the appellant had been treated as a permanent cadre member, he must be deemed a permanent employee. The Court ordered that all retiral and pensionary benefits be computed accordingly and paid within eight weeks.
