A teacher in a government-aided private educational institution claimed entitlement to enhanced superannuation age of 65 years (instead of 62) and arrears of salary for the intervening period. The High Court had initially dismissed his appeal based on an earlier Full Bench judgment denying this benefit. However, the Supreme Court had subsequently overruled that Full Bench decision in Dr. R.S. Sohane's case. The Court held that the teacher is entitled to all benefits for the period between 62 and 65 years as if he had continued in service, rejecting the State's 'no work, no pay' argument, since he was prevented from working due to the now-overruled judgment. The appeal was allowed.
