Dr. Rohit Kumar, a government doctor, successfully cleared INICET 2020 and was allotted a seat in a postgraduate course at PGI Chandigarh. However, the Delhi government denied him Study Leave due to a COVID-19 policy decision made in October 2020, causing him to lose the admission. By the time of the appeal (July 2021), COVID-19 cases in Delhi had substantially declined. The Supreme Court held that though the government's policy was legally justified when issued, manifest injustice would result from denying him relief based on a technical interpretation. Under Article 142, the Court directed PGI to admit him to the July 2021 session and the government to grant Study Leave, considering the improved COVID-19 situation.
