DR. SONIA VERMA & ANR vs THE STATE OF HARYANA & ANR

Bench: 2 — Vikram Nath, Satish Chandra Sharma

In Brief

Doctors running a maternity hospital purchased the property from its then-owner Sher Singh after previously renting it. The seller claimed his transfer was valid; the property's former owner disputed this and registered a criminal complaint against the doctors for allegedly forging the sale deed and committing fraud. The Supreme Court held that since the dispute concerns only property ownership—a civil matter—and the doctors had already filed a civil suit seeking a decree, the criminal proceedings were an abuse of law. The Court quashed the FIR, allowing the civil suit to proceed independently on its merits.
