A property owner obtained a decree to recover possession of leased land from the Municipal Corporation of Delhi after the lease expired. When the owner sought to execute the decree, the corporation claimed third parties (encroachers) were then in possession, rendering the decree unexecutable. The Supreme Court held that a decree for possession cannot be defeated merely because the judgment-debtor transferred possession to strangers. The executing court must issue warrants for physical delivery and adjudicate any resistance by encroachers under the CPC procedure for executing decrees. The Court set aside the High Court's order and remitted the case to the executing court to enforce the decree.
