The High Court reversed these decisions and decreed the suit. The Supreme Court restored the lower courts' judgments, holding that a suit for mere declaration without possession relief is not maintainable under Section 34 of the Specific Relief Act, and that non-joinder of a necessary party was fatal to the suit."
