The Court held that even if the employee had submitted a representation in 2003, waiting ten years until retirement to pursue the matter was impermissible delay. Moreover, the service records contained no contemporaneous evidence of the claimed date of birth. The Court set aside relief granted by the Labour Court and High Court, holding the employee disentitled to any relief and emphasizing that one cannot sleep over such rights indefinitely."
