G.S. Homes & Hotels P. Ltd vs Dy. Commissioner of Income Tax

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

G.S. Homes & Hotels challenged the High Court's decision regarding the taxation treatment of Rs. 45.84 lakh received as share capital from shareholders. The Supreme Court held that share capital received should not be classified as business income, reversing the High Court's error in reversing the Tribunal's order on this issue. However, the Court upheld the High Court's findings on short-term capital gains related to properties T1 and T2 and maintenance deposits. The appeal was partly allowed.
