G. Selvakumar vs State of Tamil Nadu etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

G. Selvakumar sought special leave to appeal against the High Court's dismissal of his bail application in criminal proceedings. The High Court had denied bail on the sole ground that Selvakumar had breached his undertaking to settle the matter after his release. The Supreme Court held that while a petitioner's failure to honour such undertakings is relevant, a bail application cannot be rejected on that ground alone. The application must be decided on its substantive legal merits regarding whether bail should be granted. The special leave petitions were disposed of accordingly.
