Gaddam Ramulu & Anr vs Joint Collector, Adilabad District & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

Gaddam Ramulu and his brother inherited protected tenancy rights to agricultural land in Telangana under the Andhra Pradesh Tenancy Act, 1950. Instead of cultivating it, they transferred the land to multiple persons who constructed buildings on it. After serving a show cause notice, the revenue authority cancelled their tenancy rights. The High Court dismissed their revision petition upholding the cancellation. The Supreme Court held that the transfer of land for non-agricultural purposes violated the statutory conditions of the grant. The appellants' failure to respond to the notice and the concurrent findings of all three courts below confirmed the violation, making the dismissal of the appeals justified.
