Gajanan Marotrao Nimje & Ors vs Reserve Bank of India & Ors

Bench: 2 — Kurian

In Brief

Long-serving RBI employees appointed on Scheduled Tribe reserved posts were directed by a 2012 High Court judgment to be treated as General Category employees. A 2018 High Court judgment terminated them and ordered recovery of all earned benefits. The Supreme Court partly allowed the appeal, holding that these employees are entitled to the earlier protection—they cannot be terminated but must be placed below General Category employees from 2000. Benefits earned after that date must be surrendered, except for already-superannuated employees. The Court found the 2012 judgment operated as binding on all parties through the RBI's 2013 circular.
