Gajanan Marotrao Nimje & Ors vs Reserve Bank of India & Ors

Bench: 2 — Kurian

In Brief

Employees of the Reserve Bank of India appointed under Scheduled Tribe reservation decades earlier were found not to belong to that category. A High Court ordered their termination and recovery of all service benefits. The Supreme Court partially modified this order. It held that the appellants should be reclassified as general category candidates effective 28.11.2000 and continued until retirement—consistent with an earlier High Court judgment. Only benefits earned as reserved category candidates after that date would be recovered. No recovery would be made from already superannuated employees. The termination order was set aside as disproportionate given their long service and absence of fraud evidence.">
