Gajendra Singh vs Union of India & Ors

Bench: 2 — M.R. Shah

In Brief

A Branch Manager of an Insurance Company was dismissed for issuing an insurance cover note without collecting premium, which caused financial loss when a claim arose. Though the charge was proved, the Supreme Court found the removal from service disproportionate, given the officer's unblemished 20+ year service record, good-faith reliance on a longstanding customer's assurances, and that he did not intend to maintain integrity. The Court quashed the removal order and remitted the matter to impose a lesser punishment, partly allowing the appeal."
