In Brief

The appellant, married in 1990 to the daughter of a land-loser whose property was acquired for the Kaiga Atomic Power Project, was appointed as a Helper. After matrimonial discord and the wife's father filing complaints, he was terminated on grounds of alleged misrepresentation. A Labour Court found him validly married and awarded reinstatement with back wages. A Single Judge's Writ judgment set aside this award, finding fraud. The Supreme Court held that the Single Judge ignored material evidence (marriage certificate, ration card, divorce decree) and improperly disturbed the Labour Court's factual findings. The Court restored the award, reinstating the appellant in service, but denied back wages from the Single Judge's judgment date until reinstatement.
