In Brief

The Supreme Court addressed whether reserved category candidates who received age relaxation could be treated as general category candidates if they scored higher than the last general category candidate. The Court held that such candidates cannot be migrated to unreserved vacancies because age relaxation is a concession affecting eligibility, not equivalent to fee concessions. The circular dated 11.05.2011 permitting such migration was inapplicable as it was issued after recruitment commenced in October 2010. The earlier circular dated 24.06.2008 applied instead. The Court allowed the appeals, holding that general category candidates wrongly denied appointment due to illegal migration must be appointed while allowing reserved category candidates already working to continue.
