Gauri Shankar vs Rakesh Kumar and Ors

Bench: 3 — A.M. Khanwilkar

In Brief

In this civil appeal, a property dispute arose between joint-tenants over the surrender of tenancy rights. The appellant claimed a joint tenancy in a shop but the first appellate court reversed this finding, holding that one joint-tenant could unilaterally surrender the tenancy binding the other. The High Court dismissed the appeal, deeming the matter factual rather than legal. The Supreme Court held the High Court erred by failing to examine the substantial questions of law—particularly whether the surrender was fraudulent and whether precedent cases applied. The Court allowed the appeal and remitted the case to the High Court for fresh consideration of all substantial questions on merit.
