In Brief
The Supreme Court examined whether the Reserve Bank of India must give a pre-decisional hearing before requisitioning the supersession of co-operative bank managing committees under the Karnataka Co-operative Societies Act, 1959. The High Court had held such hearing was mandatory. However, the Supreme Court left this legal question open for future determination in an appropriate case, as intervening elections to the managing committees had rendered the issue moot. The Court disposed of the appeals without deciding the core question and declared the High Court's judgment would not be treated as precedent.
