Ghanshyam Soni vs State (Govt. of NCT of Delhi) & Anr

Bench: 2 — B.V. Nagarathna, Satish Chandra Sharma

In Brief

In this criminal appeal, the Supreme Court quashed an FIR against a husband and in-laws filed by a Delhi Police officer-wife for dowry harassment and cruelty under Section 498A IPC for alleged incidents in 1999. While the Court confirmed that the complaint was filed within the three-year limitation period (Section 468 CrPC), it found the allegations vague, lacking specificity, medical evidence, or witness support. The Court held that generic accusations against distant relatives without concrete instances constitute abuse of criminal law. Exercising Article 142 powers, the Court quashed the proceedings, observing that forcing a frivolous trial would be unjust given that the parties had divorced and moved on with their lives, and emphasizing the need to prevent misuse of criminal provisions in matrimonial disputes."
