A tenant (Goel Roadways) appealed against an order for mesne profits of Rs. 60,000 per month imposed by the Rent Controller. During hearing, the Supreme Court suggested that the tenant surrender vacant possession of the premises in exchange for waiver of mesne profits. The landlord agreed. The tenant undertook to hand over possession by 14 May 2017. The Court set aside the High Court's order, restored the Rent Controller's order, and disposed of the appeal. Breach of the undertaking would attract contempt of court proceedings.
