The State of Goa issued a notification fixing minimum wages under Section 4(1)(i) of the Minimum Wages Act after consulting the Minimum Wage Advisory Board and considering worker representations seeking special allowance (Variable Dearness Allowance). Later, an Errata Notification attempted to change the basis to Section 4(1)(iii), eliminating the special allowance. The appellant union challenged this. The Supreme Court held that since the original notification reflected a conscious decision taken after due procedure, it could not be corrected as a clerical error under Section 10. The Court quashed the Errata Notification and restored the original notification with the special allowance provision.
