In Brief

The appellant sought to recover property allegedly inherited by his ancestor from a widow's estate through a granddaughter's sale deed. The widow (Seethamma) of Ramanna, who died in 1907, had sold the property to the respondents' predecessor in 1913. The Supreme Court held that since Ramanna was survived by his daughter Venkamma, the widow did not acquire absolute rights under either Hindu law or the Mysore Hindu Law Women's Right to Properties Act, 1933. Though such alienation could be ignored by reversioners, any suit for recovery must be filed within 12 years of the widow's death (1938). As the suit was filed in 1975/1985, it was time-barred. The appeal was dismissed.
