A college appointed a Vice Principal without seeking prior approval from the University of Delhi, which consequently rejected it. The respondent challenged this in the High Court, which found the rejection unjustified and ordered the University to approve the appointment and constitute a Governing Body to appoint a regular Principal. The college appealed, arguing the respondent might obstruct the appointment of a regular Principal if he became acting Principal. The Supreme Court dismissed the appeal, holding that speculative concerns cannot prevent a lawful appointment. Once the High Court directed approval based on proper findings, that decision warranted no interference.
