Government of NCT of Delhi and Anr vs M/s. Beads Properties Pvt. Ltd. & Ors

Bench: 2 — M.R. Shah, C.T. Ravikumar

In Brief

The Government of Delhi challenged a High Court order that declared land acquisition proceedings to have lapsed. The respondent (a subsequent purchaser who bought the land in 1990) had filed a writ petition to challenge the acquisition initiated in 1980. The Supreme Court held that a subsequent purchaser has no standing to challenge land acquisition proceedings or their lapsing—only the original owners may do so. The Court set aside the High Court's judgment, holding that the acquisition had not lapsed, and allowed the appeal.
