Government of NCT of Delhi vs Vijay Gupta & Ors

Bench: 2 — M.R. Shah, C.T. Ravikumar

In Brief

The Government of Delhi challenged a High Court decision that had declared land acquisition proceedings deemed lapsed under the Right to Fair Compensation and Transparency Act, 2013. The Supreme Court held that subsequent purchasers of land have no legal standing to challenge acquisition or declare it lapsed. Since the respondents purchased the land after acquisition proceedings began and could not establish valid title beyond general power of attorney and similar documents, the High Court erred in entertaining their petition. The Court quashed the High Court's judgment and held that the acquisition proceedings remain valid.
