In this civil appeal, the Supreme Court examined whether a suit for declaration should be upheld. The trial court had dismissed the plaintiffs' suit, but the First Appellate Court reversed this decision. The Supreme Court found that the plaintiffs had properly pleaded pre-existing rights in their plaint, contrary to claims otherwise. The Court also found no credible evidence of fraud in obtaining the decree. Accordingly, the Supreme Court allowed the appeal, set aside the appellate courts' judgments, and restored the trial court's original dismissal decree.
