Gurdev Singh and others vs Union of India and others

Bench: 2 — <UNKNOWN>

In Brief

This case concerns the rehabilitation rights of a displaced person from Pakistan and his heirs under the Displaced Persons (Compensation & Rehabilitation) Act, 1954. The father of the appellants was offered property at a valuation of Rs. 26,01,846 under the Act. He challenged the valuation before the Settlement Commissioner, which was dismissed on the ground that the offer had lapsed. The high court, exercising equitable jurisdiction, directed payment of the determined price with interest at 10% per annum. The Supreme Court upheld the high court's order and directed the appellants to pay the outstanding balance, permitting the property to be transferred in their favour.
