Supreme Court of India 2017-11-30 dismissed

H. Prabhakar Baliga & Anr vs Vasudeva Rao Kanemar @ V.R. Kanemar & Anr

Bench: 2 — Kurian

In Brief

The appellants, tenants facing eviction, argued that a House Rent Control Petition filed against them should be dismissed because a subsequent amendment to the Karnataka Rent Control Act, 1961 created a bar against such petitions under Section 2(7). The Supreme Court held that this bar does not apply to proceedings already initiated before the amendment took effect. Relying on prior precedent, the Court dismissed the appeal, but granted the tenants extended time until March 31, 2018 to vacate the premises.
