Supreme Court of India 2017-11-30 dismissed

H. Prabhakar Baliga & Anr vs Vasudeva Rao Kanemar @ V.R. Kanemar & Anr

Bench: 2 — Kurian

In Brief

Tenants challenged an eviction petition as unmaintainable due to a bar under Section 2(7) of the Karnataka Rent Control Act, 1961 created by subsequent amendment. The Supreme Court held that proceedings initiated before an amendment are not affected by the amendment's subsequent bar. The appeal was dismissed, but tenants were granted time to vacate the premises by 31 March 2018, subject to filing an undertaking within three weeks.
