This appeal concerns a private road of 414.14 sq. meters on land owned by the Hari Krishna Mandir Trust. The Pune Municipal Corporation was incorrectly listed as the owner in the Town Planning Scheme of 1979, though it never acquired the land through any legal procedure. The appellant sought correction of this error. The High Court dismissed the petition, finding the land had vested in the Corporation under the Act. The Supreme Court reversed this, holding that the Executive cannot deprive property without legal authority. The Arbitral Award of 1972 clearly showed the road was held by the adjacent plot owners. The Court directed the Municipality to correct the records and reflect the true owners, conditional on the Trust granting access rights to adjacent plot holders.
