Hari Ram (Deceased) Thr. His LRs. and Anr vs Land Acquisition Collector cum District Revenue Officer Gurgaon and Ors

Bench: 2 — M.R. Shah, M.M. Sundresh

In Brief

The Supreme Court examined whether land compensation in an acquisition for a Liquified Petroleum Gas Plant should be fixed at Rs. 7,00,000 per acre (as the High Court determined) or at a higher rate based on sale exemplars. The Court held that the High Court wrongly rejected sale deeds merely because they involved corporate transactions with varying prices. Using those sale deeds and making a 35% adjustment for smaller parcel size and modest development needs, the Court fixed fair compensation at Rs. 12,16,800 per acre. The appeal was partly allowed and the High Court's order modified."
