Harijan Paniben Dudabhai vs State of Gujarat & Ors

Bench: 2 — Uday Umesh Lalit

In Brief

The Supreme Court held that employees appointed by Gram Panchayat through resolutions, without formal selection procedures under the Gujarat Panchayats Act, 1961, are entitled to pensionary benefits (family pension and gratuity) if they served as regular full-time employees on sanctioned posts. The Court found that absent recruitment rules at the 1964 appointment time did not invalidate the appointment. For employees with 30+ years of uninterrupted service without any contemporaneous challenge to appointment validity, and who received regular salary throughout, the Court held such appointments were valid and entitled beneficiaries to statutory benefits."
