VINOD KANJIBHAI BHAGORA vs STATE OF GUJARAT & ANR

Bench: 2 — Vikram Nath, Satish Chandra Sharma

In Brief

A postal assistant who worked for the Central Government for 10 years obtained a no-objection certificate and joined the State Government as a Senior Assistant after tendering resignation from his Central position. Upon retirement, the State paid pension only for his State service period. The Supreme Court held that 'absorption' under the pension rules encompasses both explicit and implicit absorption, and this employee's prior Central service must count toward his pension calculation. The Court rejected a narrow interpretation and directed recalculation of benefits with arrears paid within 6 weeks.
