Haris K vs Saju George and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Haris K sought appointment in a Non Joining Duty vacancy with the Public Service Commission, which was rejected by the PSC, State Administrative Tribunal, and High Court. When the Supreme Court directed fresh consideration, the PSC again rejected the request. The petitioner filed a contempt petition. The Supreme Court dismissed the petition but, invoking Article 142 of the Constitution, directed the PSC to issue an advice for appointment within two weeks as a special case. The appointing authority was ordered to issue appointment orders immediately upon receiving the advice. The Court treated this as a measure for complete justice without creating precedent.
