Harish Dahiya and his wife (sister-in-law of a deceased person) were prosecuted for abetting suicide under Section 306 read with Section 34 of the IPC. The Additional Sessions Judge refused to discharge them, citing an earlier dismissal of a petition to quash the entire prosecution. The High Court upheld this order. The Supreme Court found that this reasoning amounted to an abdication of jurisdiction. The Court held that the grounds for quashing a prosecution and those for discharging an accused are wholly different legal questions. The discharge application required independent consideration on its own merits. The Court allowed the appeal and remanded the matter for fresh consideration by the Additional Sessions Judge."
