The State appealed against a High Court order discharging an accused (Smt. S. Selvi) from criminal charges for criminal intimidation (IPC Section 506(i)). The alleged incident concerned threats made during a property transaction dispute in 2011. The High Court had discharged her based on a discrepancy in the alleged incident timing (morning vs. evening). The Supreme Court held that a mere timing discrepancy cannot justify discharge at the preliminary stage. The Court ruled that whether the accused was actually present is a factual matter for trial, not discharge proceedings. The material on record was sufficient to frame charges as the complaint disclosed threats made to the complainant. The judgment was set aside, and the case was remanded to the trial court to proceed."
