HARPREET KAUR & ORS vs MOHINDER YADAV & ORS

Bench: 2 — Krishna Murari, S. Ravindra Bhat

In Brief

A farmer aged 35 died in a motor vehicle accident when a truck negligently collided with his car. His widow, two minor children, and mother filed a claim for compensation under the Motor Vehicles Act, 1988. The High Court had awarded ₹17,66,000. The Supreme Court enhanced the award to ₹25,20,000 for loss of dependency by reassessing the deceased's actual income at ₹1,50,000 p.a. (instead of ₹95,000) based on his extensive agricultural holdings. The Court also awarded ₹40,000 each to the two children and mother as filial and parental consortium (₹1,20,000 total), recognizing the non-pecuniary loss of love, affection, and companionship under Motor Vehicles Act principles.
