In Brief
A motorcyclist died in a collision with a state transport bus caused by negligent driving. The Motor Accident Claims Tribunal awarded Rs. 8,51,000/- in compensation, which the High Court affirmed. The deceased's family challenged the award for enhancement. The Supreme Court upheld the tribunal's calculation of loss of dependency (Rs. 7,20,000/-) but granted additional compensation of Rs. 6,00,000/- to cover loss of estate, loss of consortium, funeral expenses, and a 40% addition for future prospects of income, in accordance with the National Insurance v. Pranay Sethi precedent. Total compensation was thus enhanced.
