Harsh International & Anr vs Union of India & Ors

Bench: 2 — Kurian

In Brief

Harsh International, a 100% export-oriented unit in Noida Special Economic Zone, sought exemption from plastic waste management rules to manufacture filters in plastic packaging for export. The Supreme Court allowed the writ petition, following its earlier decision in Baba Global Ltd. The Court held that where an export unit files an undertaking and manufactures exclusively for exports, it qualifies for exemption from the Plastic Wastes (Management & Handling) Rules, 2011. The petitioner's compliance with the undertaking requirement rendered it exempt from the operational restrictions of the rules.
